General Terms and Conditions of Exklusiv Chemie GmbH

§1 Scope of application for consumers and definitions

(1) The following General Terms and Conditions apply to all deliveries between us and a consumer in the version valid at the time of the order.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed professional activity (§ 13 German Civil Code – BGB).

§2 Conclusion of contract and storage of the contract text

(1) The following provisions regarding the conclusion of the contract apply to orders placed via our online shop at https://exklusiv-chemie.de.

(3) The presentation of goods in our online shop does not constitute a legally binding offer on our part, but merely a non-binding invitation for the consumer to order goods. By ordering the desired goods, the consumer submits a binding offer to conclude a purchase contract.
(4) Upon receipt of an order in our online shop, the following provisions apply: The consumer submits a binding contractual offer by successfully completing the ordering process provided in our online shop.

The order is placed in the following steps:

1) Selection of the desired goods
2) Confirmation by clicking the “Order” button
3) Review of the information in the shopping cart
4) Clicking the “Proceed to checkout” button
5) Logging into the online shop after registration and entering login details (email address and password)
6) Review and correction of the entered data
7) Binding submission of the order by clicking the “Order with obligation to pay” or “Buy” button

Before submitting the binding order, the consumer can return to the website where the customer’s details are recorded by using the “Back” button in the internet browser used, in order to correct any input errors, or cancel the ordering process by closing the browser. We confirm receipt of the order immediately by means of an automatically generated email (“Order confirmation”). This constitutes acceptance of your offer.

(5) Storage of the contract text for orders placed via our online shop: We store the contract text and send you the order data and our General Terms and Conditions by email. You can also view the GTC at any time at https://exklusiv-chemie.de/Seiten/Links/AGB/. Your past orders can be viewed in our customer area under My Account → My Orders.

§3 Prices, shipping costs, payment, due date

(1) The prices stated include statutory VAT and other price components. Any shipping costs will be added.

(2) The consumer has the option of paying via PayPal or credit card (Visa, Mastercard, American Express).

§4 Delivery

(1) Unless otherwise clearly stated in the product description, all items offered by us are ready for dispatch immediately. Delivery will be made no later than within 5 working days. In the case of payment in advance, the delivery period begins on the day after the payment order is issued to the bank responsible for the transfer, and for all other payment methods on the day after the contract is concluded. If the end of the period falls on a Saturday, Sunday or public holiday at the place of delivery, the period ends on the next working day.

(2) The risk of accidental loss and accidental deterioration of the sold item passes to the buyer only upon handover of the item to the buyer, even in the case of shipment.

§5 Retention of title

We retain ownership of the goods until full payment of the purchase price has been made.

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you or a third party designated by you, who is not the carrier, has taken possession of the goods.

by means of a clear statement (e.g. a letter sent by post, fax or email) of your decision to withdraw from this contract. You may use the attached model withdrawal form, but this is not mandatory.

Consequences of withdrawal

If you withdraw from this contract, we shall reimburse all payments received from you, including delivery costs (with the exception of additional costs resulting from your choice of a type of delivery other than the cheapest standard delivery offered by us), without undue delay and no later than fourteen days from the day on which we received notification of your withdrawal from this contract. We will use the same means of payment for this reimbursement as you used for the original transaction, unless expressly agreed otherwise; in no case will you be charged any fees for this reimbursement.

We may withhold reimbursement until we have received the goods back or until you have provided evidence that you have returned the goods, whichever is the earlier.

You must return or hand over the goods to us without undue delay and in any event no later than fourteen days from the day on which you inform us of the withdrawal from this contract. The deadline is met if you send the goods before the expiry of the fourteen-day period.

You bear the direct costs of returning the goods.

Financed transactions

If you have financed this contract by means of a loan and you withdraw from the financed contract, you are no longer bound by the loan agreement either, provided that both contracts form an economic unit. This is particularly the case if we are also your lender or if your lender makes use of our involvement with regard to the financing. If the loan has already been paid to us at the time the withdrawal or return becomes effective, your lender assumes our rights and obligations arising from the financed contract with regard to the legal consequences of the withdrawal or return. This does not apply if this contract relates to the acquisition of securities, foreign exchange, derivatives or precious metals. If you wish to avoid a contractual commitment as far as possible, please withdraw from both contractual declarations separately.
